I'm interested in selling my applseed processor, methanol and tote filled with oil but I'm worried about protecting myself should the new owner injure themselves using it. I don't want to get sued. Has anyone written a document and had buyer sign to protect themselves? I'm wondering if it's not worth the risk.

I understand that this equipment if sold used and as-is with no real or implied warranty and that the seller is not to be held liable for it's misuse or failures on my part to follow proper safety protocol.

That should all fit easily into a couple paragraphs or so as is as basic as it can get. It is not ambiguous so as to let some lawyer spin out of it.

Yup, all that legal civil tort crap (along with rudimentary criminal law) I took has it's use from time to time.

Of course, it is always a good idea to CYA (Cover Your Ass.ets) whenever selling equipment to people who may or may not have a good grasp of the safety protocols involved. In other words, if it goes "bang" you get to sleep at night.

I had a guy who wanted to trade me a nice 12ga shotgun for my old enclosed trailer, but when I suggested that we probably each sign a simple document like that one, he never called me back again.

I suppose having a CYA mindset can function to CYA even if you don't get to actually signing anything. It was a nice gun, but if he had an issue with having a paper trial...its probably not one I want to own!
