From the comfort of your chair, do take the small effort to support the Green Party and other initiatives against this ludicrous giveaway of our sovereignty and democratic process-

Ask yourselves what of the following is reasonable or even sane:

"The Canada-China Investment Treaty allows Chinese companies (including state-owned enterprises) to sue the Government of Canada over decisions that can limit or reduce their expectation of profits. In treaty language, this is called “tantamount to expropriation.” China can claim damages against Canada for decisions at the municipal, provincial, territorial or federal level. Even decisions of our courts can give rise to damages. The damage claims start with six months of diplomatic negotiation. If that fails, damage claims move to arbitration – behind closed doors.

4. Secret hearings

The Canada-China Investment Treaty would allow Chinese investors to sue Canada outside of Canadian courts. Special arbitrators would take the decisions. These arbitrators, unlike judges, do not have secure tenures or set salaries. Their decision cannot be subject to judicial review. And the arbitrations are to be secret. Even the fact they are happening is to be secret.

The Foreign Investment and Protection Act is deeply troubling on all levels;. it appears to completely subvert democratic principles of openness and transparency by granting foreign investors extraordinary power to challenge public policy and judicial process outside of Canadian courts- in absolute secrecy.

Apparently under FIPPA, investors can challenge policy and legislation at any level- Municipal/Civic, Regional, Provincial and Federal. Undermining all these jurisdictions could well lead to expensive supreme court challenges.

That your government drafted this treaty in secret and will not allow any debate on the matter is an affront to reason and decency. Further, that this treaty grants such control to Chinese government owned corporations is shocking.
FIPPA endorses Chinese government totalitarianism, human rights, wage and labour policy as well as the illegal invasion of Tibet and the brutal suppression of dissent as demonstrated at Tianamen Square.
FIPPA is an insult to the thousands of Canadians who died fighting regimes that behaved like China.
FIPPA would, if passed, erode Canadian employment, health and safety and environmental standards- It would also add senseless costs in arbitration and settlements.

With 39% of the vote and serious unresolved electoral fraud issues from the last election, you do not have a carte blanche mandate.

I have two important questions for you:

FIPPA is another example of what seems to be a "Trickle Down" approach to national economics. I can't think of a durable example of such policies that ended well- the French and Russian revolutions come to mind, as does our bankrupt southern neighbour.

China's economic model would not please the vast majority of Canadians if they were forced to live under it.......


Can you as a student of economics point to a succesful, harmonious and somewhat egalitarian model of your policy direction?


Will you, Stephen Harper, act in the greater interests of civil Canadian society and postpone the implementation of FIPPA to allow debate and input as is only right and proper?

With 46% of the vote in the last election, you do not have a carte blanche mandate; nationally the percentage is lower.

I remind you of your duty as a Member of Parliament in the words of Edmund Burke:

"It is his duty to sacrifice his repos, his pleasures, his satisfaction, to constituents; and above all, ever and in all cases, to prefer their interests to his own."

Will you, John Duncan, act in the greater interests of civil Canadian democracy and oppose the current draft of FIPPA?

History would not be kind to those that stood with what has rightly been called an act of treason.

You have failed to respond to my letter of October 17th concerning the largest threat to Canada in decades.
As outlined in Law Professor Gus Van Harten's letter to Stephen Harper, hidden minority investors could use FIPPA to undermine legislation at the regional, provincial and federal levels. With significant resource projects proposed and underway in British Columbia FIPPA would undoubtedly effect us here.

The threats to worker safety are not theoretical: a Canadian coworker of mine was onsite when two TFW Chinese workers were killed and five injured at a CNRL site in Alberta in 2007- The courts found a way to drop all the charges against companies with a real Canadian presence.

The manner in which the federal government, itself convicted of contempt of parliament in 2011, is trying to impose this without allowing any debate is reprehensible in the extreme.

This same government has been illegally blocking court cases and criminal investigations which could affect it's very legitimacy.

As suggested by my Regional District of Comox Valley director Edwin Grieve I phoned MP John Duncan's office and requested a meeting with Mr. Duncan and wrote a letter. I followed up my phone call with a visit to his office four days later and was again deflected.

The next day I attended a "letter writing bee" where it arose anecdotally that MP Duncan rarely responds to letters.

At this point, it is incumbent upon any publicly elected official in Canada who cares about what we like to call democracy to oppose FIPPA
with whatever tools and levers they possess.

Those that do not we know to be unfit for public office.

Will you, Don McRae, act IMMEDIATELY in your capacity as a MLA and stand up for your electorate?

4. Usually, the capital-importing position under these treaties is occupied by a developing or transition economy. Under the Canada-China treaty it is occupied by Canada. This poses a serious fiscal risk. Notably, to sue under the treaty, a Chinese company requires only a minority share in any Canadian enterprise or other asset in Canada. Based on interpretations by arbitrators in numerous cases, a Chinese investor could obtain, or may already have obtained, ownership in Canadian assets via a holding company in a secrecy jurisdiction such as the Cayman Islands, without losing its right to sue under the Canada-China treaty. What steps have you taken to ensure that there is not now and will not be in future Chinese-ownership of assets of which the government is unaware?

1. The legal consequences of the treaty will be irreversible by any Canadian court, legislature or other decision-maker for 31 years after the treaty is given effect. The treaty has a 15-year minimum term, requires one year's notice prior to termination, and adds another 15-years of treaty coverage for assets that are Chinese-owned at the time of termination. By contrast, NAFTA for example can be terminated on six months notice.
2. Other investment treaties (aka FIPAs) signed by Canada have a similar duration and, in this respect, are exceptional among modern treaties. Yet none put Canada primarily in the capital-importing position. As such, the Canada-China treaty effectively concedes legislative and judicial elements of our sovereignty in a way that other FIPAs do not. Chinese asset-owners in Canada will be able, at their option, to challenge Canadian legislative, executive, or judicial decisions outside of the Canadian legal system and Canadian courts.
3. To elaborate, the treaty will likely be largely de facto non-reciprocal due to anticipated in-flows of Chinese investment to Canada outstripping Canadian investment in China. The deal gives Cadillac legal status to Canadian investors in China and vice versa. Yet Canada will be much more exposed to claims and corresponding constraints as a result of the de facto non-reciprocity. Two awards of a billion dollars-plus, and many over $100 million, have been issued against countries to date under these treaties, with more likely on the way. The awards are immune from judicial review, largely or entirely, and are often extra-territorial, depending on how the investor's lawyers frame the claim.

Farmers say entire organic industry at risk in GM alfalfa debate

GUELPH, Ont. – There’s a new genetically modified crop on the horizon that some say is jeopardizing the entire Canadian organic farming industry.

Organic farmers across the country are sounding the alarm bells on the state of alfalfa, one small plant with a massive role in organic farming.

When most people hear the word alfalfa they generally think of sprouts they buy in the grocery store.

However, full-grown, dried alfalfa is a high-protein feed for pigs, poultry, dairy cows, beef cattle and lambs and is used to increase the nutrients in soil.

In order to be certified organic, foods cannot be produced with genetically modified crops and chemical sprays.

The crop at the centre of this debate is Monsanto’s herbicide tolerant, genetically modified (GM) alfalfa. It has already been deregulated in the U.S. and north of the border seed growers and conventional farmers are meeting to discuss the possibility of commercializing GM alfalfa in Canada.

This November, the Canadian Seed Trade Association (CSTA) is meeting with members of Forage Genetics International to discuss the status of herbicide tolerant alfalfa in the U.S. and Canada and develop a coexistence plan for GM alfalfa.

Critics argue that organic crops and GM crops cannot coexist, as cross-pollination of GM alfalfa to organic crops is inevitable – making organic certification impossible.

“The consensus among the food scientists is that once it's out there, it will inevitably contaminate the entire seed supply,” said Ted Zettel, from the Canadian Organic Federation.

“I'm sure that I'll lose my certification,” said organic dairy farmer John Brunsveld.

A spokesperson for the CSTA said they were unable to respond to questions from Global News until a "value chain workshop" on an alfalfa coexistence plan is completed. That workshop is scheduled to begin on Wednesday.

An additional worry for farmers is the loss of exports they could suffer.

Canada exports $29-million worth of alfalfa each year, often to countries where genetically modified organisms are banned.

“So many other countries have banned [GMOs] in their food system. Once our alfalfa is contaminated, there are very few countries in the world that are going to want an export of ours,” said Sarah Dobec from the Canadian Biotechnology Action Network’s “Stop GM Alfalfa” campaign.

With that business lost, the cost of organic food could skyrocket. With fewer locally grown organic products available for sale, Canada would need to increase imports in order to meet demand.

These effects may force organic farmers to close up shop or change their definitions of what makes something organic.

“I don’t think we can have an organic industry without growing alfalfa,” said Zettel. “It won’t be the industry that we have now because we’re so dependent on it for livestock feed.”

Several grassroots groups are rallying to raise awareness for the issue. This Wednesday, the National Farmers Union will hold a protest in Kitchener, Ont., in order to stop plans to introduce GM alfalfa in Ontario.
